We are proficient in handling matters involving the Insolvency and Bankruptcy Code 2016. Our approach to IBC matters involves understanding the clients’ end goal followed by evaluating legal options to put together the strategy most suitable to the client. 

Our IBC mandates cover the spectrum of disputes starting with pre-litigation advice, filing of claims, and handling of the case through its lifecycle, including litigation before the NCLT, NCLAT, High Courts and the Supreme Court. We represent all stakeholders including creditors, debtors, claimants, and liquidators.

Representation in CIRP proceedings

Representation of a large Public Sector Bank in CIRP proceedings under the IBC 2016, against a manufacturing company.    

Proceedings initiated by financial creditors  

Legal advice and representation services to a Bengaluru-based real estate business in proceedings for default initiated by a non-banking financial company as a financial creditor before the National Company Law Tribunal. 

Proceedings initiated by financial creditors

Represented one of India’s largest manufacturers of batteries and related products in proceedings for default initiated by a creditor-NBFC as a financial creditor before the NCLT under the Insolvency and Bankruptcy Code, 2016.

Representation in proceedings initiated by NBFC as financial creditor  

Representation of a prominent real estate developer in South India, in IBC proceedings for default in payment of non-convertible debentures initiated by a non-banking financial company as a financial creditor before the National Company Law Tribunal.

Representation in proceedings initiated by operational creditors 

Representation of a leading manufacturing concern in proceedings initiated before the National Company Law Tribunal under the IBC, 2016, by various operational creditors. 

Representation before NCLT and NCLAT  

Represented a real estate developer in Hyderabad in proceedings initiated by an operational creditor before the NCLT and in appeal before the NCLAT. 

Representation before NCLT in oppression and mismanagement proceedings 

Representation of a mid-sized manufacturing company in Bengaluru and its majority shareholders in disputes with a minority shareholder claiming oppression and mismanagement. 

Restructuring advice and representation in proceedings for sanction of amalgamation proceedings 

Advice to a construction equipment manufacturer in proceedings for restructuring its business and representation before the NCLT for sanction of scheme of amalgamation of holding company and its wholly- owned subsidiary. 

Restructuring advice and representation in NCLT and NCLAT proceedings 

Advice to a private company in Bengaluru on restructuring of its businesses into separate entities and representation of the entities in NCLT proceedings for sanction of the scheme of arrangement (and in interim appellate proceedings before the NCLAT).

Representation in debt recovery proceedings  

Representation of a textile manufacturing company in proceedings initiated by a large public sector bank before the Debt Recovery Tribunal, for recovery of debts extended under various facilities.
